Version 2.1 · Effective 31 October 2026

1. Introduction

Welcome to 45SHOT.

45SHOT is an event photo and video sharing platform that allows event organisers to create shared galleries and invite guests to upload, view and download photographs and videos.

These Terms of Service govern your use of the 45SHOT website, organiser accounts, event galleries and related services.

By creating an organiser account, creating an event, joining a gallery or uploading content, you agree to the terms that apply to your use of the service.

If you do not agree with these terms, you must not use the relevant part of the service.

2. Who operates 45SHOT?

45SHOT is operated by:

  • Company: 45shot (PTY) LTD
  • Registration number: 2026/856337/07
  • Registered business address: Port Elizabeth, South Africa
  • Website: https://45shot.com
  • Contact email: support@45shot.com

In these terms, "45SHOT", "we", "us" and "our" refer to 45shot (PTY) LTD.

"You" and "your" refer to any organiser, guest or other person using 45SHOT.

3. Eligibility

You must be legally capable of entering into a binding agreement to create an organiser account or purchase an event.

If you are under 18, you may only use the service with the involvement and permission of a parent or legal guardian where required by law.

You agree to provide accurate information when using 45SHOT and not to impersonate another person.

4. How 45SHOT works

45SHOT allows an organiser to:

  • Create an event gallery.
  • Set event details.
  • Choose available gallery access settings.
  • Share an event link or QR code.
  • Allow guests to upload photographs and videos.
  • Manage and remove content.
  • View and download event media, subject to available features.

Guests can access an event through its QR code, event link or event code. Guests do not ordinarily need to create an account to upload content.

An event may be public or protected by an access code, depending on the organiser's settings.

Anyone who obtains a valid event link, QR code or access code may be able to enter the gallery. Organisers must therefore take care when distributing access details.

5. Organiser responsibilities

When you create or manage an event, you are responsible for the event and the way its gallery is used.

You agree to:

  • Provide accurate event information.
  • Protect your organiser account and login details.
  • Distribute gallery access details responsibly.
  • Choose appropriate privacy and access settings.
  • Inform guests that photographs and videos may be shared in the event gallery.
  • Obtain any notices, permissions or consents required for photographing and sharing images at your event.
  • Respect requests from people who appear in photographs or videos.
  • Remove content where appropriate.
  • Ensure that event activities and uploads comply with applicable law.

You are responsible for the content and access settings of your event.

45SHOT provides the gallery technology. We do not organise your event, supervise your guests or automatically obtain consent from every person attending or appearing in photographs.

6. Guest responsibilities

As a guest, you agree that:

  • You will only upload content that you have the right or authority to share.
  • You will respect the privacy, dignity and rights of people appearing in your uploads.
  • You understand that other authorised gallery users may view your uploads.
  • You understand that downloads may be available where enabled by the organiser.
  • You will not use the gallery to harass, embarrass, threaten, exploit or harm another person.
  • You will provide accurate information where the service requests it.

Before uploading, you should consider whether the content is appropriate for a shared event gallery.

If you are unsure whether you have permission to share a photograph or video, do not upload it.

7. Your content and ownership

You retain ownership of photographs and videos that you upload, subject to the rights of any other copyright owners or people whose rights may be affected.

Uploading content does not transfer ownership or copyright to 45SHOT.

However, to operate the service, you grant 45SHOT a limited, non-exclusive, worldwide, royalty-free licence to:

  • Receive and store your uploaded content.
  • Process and resize files.
  • Generate display versions and thumbnails.
  • Display the content within the relevant event gallery.
  • Make content available for viewing or downloading according to the event settings.
  • Perform technical operations reasonably necessary to provide, secure and maintain the service.

This licence is limited to operating and providing 45SHOT.

We do not claim ownership of your content and do not use uploaded event photographs or videos for advertising or machine-learning model training.

The licence ends when the content is removed, except for limited copies retained temporarily for backups, legal compliance or legitimate security purposes.

8. Content that is not allowed

You must not upload, share or use 45SHOT to distribute:

  • Illegal content.
  • Content that infringes copyright, trademarks or other intellectual property rights.
  • Intimate images shared without the necessary consent.
  • Sexual or exploitative content involving children.
  • Images or videos intended to threaten, harass, humiliate or endanger another person.
  • Content that is defamatory, hateful or discriminatory.
  • Content that violates another person's privacy or applicable data protection laws.
  • Content that impersonates another person or falsely claims ownership.
  • Malicious files, harmful software or content intended to compromise the platform.
  • Spam, scams or unrelated promotional material.
  • Content that encourages violence or unlawful conduct.

You must not attempt to:

  • Access another person's account or event without permission.
  • Bypass event access restrictions.
  • Interfere with the operation or security of 45SHOT.
  • Scrape, copy or extract information from the platform through unauthorised automated methods.
  • Reverse engineer or misuse the service except where applicable law permits it.

9. Reporting and removing content

We take reports of harmful or unauthorised content seriously.

If you believe a photograph, video, event or user is violating these terms, contact:

support@45shot.com

Where possible, include:

  • The event link or event name.
  • The photograph or video concerned.
  • A description of the issue.
  • Your contact details.
  • Any information that helps us assess the report.

We may remove or restrict access to content, suspend an event or restrict an account where we reasonably believe that:

  • These terms have been breached.
  • Content is unlawful or harmful.
  • A person's safety or privacy is at risk.
  • We are legally required to take action.
  • The security or proper operation of the service is threatened.

We may act immediately where necessary to protect people or comply with the law.

Where appropriate, we will notify the relevant organiser or uploader and explain the action taken.

10. Copyright complaints

If you believe content on 45SHOT infringes your copyright, email support@45shot.com.

Please provide:

  • A description of the copyrighted work.
  • The link or event details identifying the content.
  • Your contact information.
  • A statement explaining why you believe the use is unauthorised.
  • Confirmation that the information provided is accurate to the best of your knowledge.

We may restrict access to the relevant content while investigating the complaint.

We may request further information before making a decision.

11. Gallery access and downloads

An event organiser controls access to their event through the available gallery settings.

A person who obtains valid access may be able to view content in the gallery.

Where downloads are enabled, authorised users may download available content.

A gallery access permission does not give you ownership of the photographs or videos.

Unless you have separate permission from the copyright owner, you may not commercially exploit, sell, republish or otherwise use downloaded content in a way that infringes another person's rights.

You must not use downloaded content to harass, threaten, embarrass or harm anyone.

45SHOT cannot control what users do with content after they have downloaded it. Users should therefore consider the consequences of sharing content in a gallery.

12. Find Me and optional features

45SHOT may introduce optional features that help users find photographs of themselves.

If a feature involves processing biometric information, it will be subject to additional privacy information and any required consent.

You are not required to use optional biometric features to access an ordinary event gallery.

The availability of optional features may change as the platform develops.

13. Event duration, storage and deletion

45SHOT is designed for event sharing, not permanent cloud storage.

Unless a different period is clearly displayed or agreed for a particular event:

  • Guests may upload content during the event and for up to 7 days after the event ends.
  • The gallery and its stored media are scheduled for deletion 30 days after the event ends.
  • We may send reminders to organisers before scheduled deletion.
  • Organisers should download any content they wish to retain before the deletion date.

Organisers may delete individual photographs or events earlier.

When content is deleted, it is removed from active gallery access and queued for removal from storage. Limited backup copies may remain temporarily where required for security, technical or legal reasons.

You are responsible for keeping your own copies of important photographs and videos. We do not guarantee permanent storage or recovery after deletion.

14. Pricing and payments

45SHOT may charge organisers a once-off fee for creating or activating an event.

The applicable price, package, upload allowance, included features and any other charges will be displayed before payment.

Unless expressly stated otherwise:

  • Payment applies to the specific event purchased.
  • Event purchases are not recurring subscriptions.
  • Payment does not automatically renew.
  • Payment confirmation is required before paid features are activated.
  • Payment is processed through the payment provider displayed at checkout.

We do not store your full payment card details.

14.1 Payment errors

If a payment is deducted but the event is not activated, contact support@45shot.com with your transaction reference.

We will investigate and take reasonable steps to resolve the issue.

14.2 Cancellations and refunds

Refunds and cancellations are subject to applicable South African consumer law, including the Consumer Protection Act and the Electronic Communications and Transactions Act.

If you request cancellation or a refund, contact support@45shot.com and provide your event details and payment reference.

We will assess the request based on:

  • Whether the service has been activated or used.
  • Whether the service was delivered as described.
  • Whether a technical failure prevented the service from being provided.
  • Any applicable statutory cancellation or refund rights.

Nothing in these terms removes or limits a consumer right that cannot lawfully be excluded.

Where a refund is approved, it will ordinarily be processed through the original payment method or another appropriate method.

15. Service availability and technical limitations

We aim to keep 45SHOT available and functioning reliably.

However, the service depends on internet connections, hosting providers, storage services and other infrastructure that may occasionally experience interruptions.

We do not guarantee that:

  • The service will always be available without interruption.
  • Every upload will succeed on the first attempt.
  • Every device or browser will support every feature.
  • Content can always be recovered after deletion.
  • Every photograph or video will display perfectly on every device.

We may temporarily restrict access for maintenance, security, upgrades or technical reasons.

Where reasonably possible, we will try to minimise disruption.

16. Intellectual property belonging to 45SHOT

The 45SHOT name, logo, branding, website design, software, interface, text, graphics and other platform materials are owned by or licensed to 45SHOT.

You may use the service for its intended purpose.

You may not copy, reproduce, distribute, modify, sell or commercially exploit our intellectual property without our prior written permission, except where applicable law permits it.

Nothing in these terms transfers ownership of the 45SHOT platform or its intellectual property to you.

17. Account suspension and termination

You may stop using 45SHOT at any time.

You may request account deletion by contacting support@45shot.com.

We may suspend or terminate access where:

  • You seriously or repeatedly breach these terms.
  • Your use is unlawful or harmful.
  • You threaten the security or proper operation of the platform.
  • We are legally required to do so.
  • Payment fraud or other serious abuse is suspected.

Where reasonably possible, we will notify you and provide an opportunity to address the issue before suspension.

We may take immediate action where necessary to protect users, content or the service.

Suspension or termination does not remove rights or obligations that arose before the suspension or termination.

18. Limitation of liability

We provide 45SHOT with reasonable care and skill.

To the extent permitted by law, we are not responsible for:

  • Loss caused by an event organiser's access settings or distribution of gallery links.
  • Content uploaded by users.
  • A user's misuse of photographs or videos after downloading them.
  • Loss caused by an internet, hosting or third-party service interruption outside our reasonable control.
  • Content deleted in accordance with the retention schedule after appropriate notice.
  • Loss caused by a user's failure to keep their own backup copies.

Nothing in these terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes rights or remedies that consumers have under applicable South African law, or liability that cannot lawfully be excluded.

19. Indemnity

To the extent permitted by law, you are responsible for losses, claims or expenses directly arising from your unlawful use of 45SHOT or your serious breach of these terms.

This does not make you responsible for losses caused by our own unlawful conduct or negligence, or remove any consumer rights that cannot lawfully be excluded.

20. Privacy

Your use of 45SHOT is also governed by our Privacy Policy:

https://45shot.com/privacy

The Privacy Policy explains how we collect, use, store and protect personal information.

By using the service, you acknowledge that you have been given access to the Privacy Policy.

Where the law requires consent for a particular type of processing, using the service or accepting these terms does not replace that separate consent.

21. Changes to the service and these terms

We may improve, update or change 45SHOT as the product develops.

We may also update these terms to reflect changes in our services, legal obligations or business operations.

The latest version will be published at:

https://45shot.com/terms

Where a change materially affects your rights or obligations, we will provide appropriate notice and, where required, obtain your acceptance before you continue using the affected service.

A change to these terms does not retrospectively remove rights that have already accrued.

22. Complaints and disputes

If you have a complaint or dispute, please contact us first:

Email: support@45shot.com

We aim to acknowledge complaints within five working days and work towards resolving them as soon as reasonably possible.

These terms are governed by the laws of the Republic of South Africa.

Nothing in this section prevents a consumer from exercising a right to approach a court, regulator, ombud or other dispute-resolution body with jurisdiction.

23. General provisions

If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

A failure by 45SHOT to enforce a provision does not mean that we have waived our right to enforce it later.

These terms, together with the Privacy Policy and any applicable event-specific purchase terms, form the agreement governing your use of the service.
